Pension benefits are considered an asset in divorce and separation proceedings.
Pension Adjustment Order (PAO)
A PAO is a court order that enables a former spouse or civil partner, and dependents, to receive a portion of a scheme member's pension.
If a PAO is in place, benefits are payable in accordance with the PAO, and not the pension scheme rules. If a PAO is not in place, benefits are payable in accordance with the pension scheme rules.
Applying for a PAO
When granting a divorce or judicial separation, the court may issue a PAO. Alternatively, once the court grants a divorce or judicial separation, either spouse can seek a PAO from the court.
